Por: Estefany Vasquez"},"content":{"rendered":"<p><strong>NOTI-AMERICA.COM<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>\u00bfSab\u00edas que las empresas tienen la obligaci\u00f3n de adoptar medidas para prevenir el hostigamiento sexual en el \u00e1mbito laboral?<\/strong><\/p>\n<p>La violencia de g\u00e9nero puede manifestarse en diversos entornos, no solo en el hogar, sino tambi\u00e9n en los diferentes contextos de la vida cotidiana, incluido el \u00e1mbito laboral. En Per\u00fa, a partir del a\u00f1o 2022, la Superintendencia Nacional de Fiscalizaci\u00f3n Laboral (SUNAFIL) emiti\u00f3 el Protocolo de Fiscalizaci\u00f3n en materia de Hostigamiento Sexual, el cual define el hostigamiento sexual como cualquier conducta sexual o sexista dirigida hacia una persona que no la desea, pudiendo generar un ambiente hostil, intimidatorio o afectar sus actividades laborales y no laborales, sin necesidad de que la v\u00edctima haya rechazado expl\u00edcitamente dicha conducta o de que haya ocurrido de forma reiterada.<\/p>\n<p>Es importante destacar que, mientras que la conducta sexual implica acciones de naturaleza sexual, la conducta sexista involucra comportamientos discriminatorios hacia una persona en funci\u00f3n de su sexo, reforzando estereotipos que presuponen su subordinaci\u00f3n respecto al otro sexo.<\/p>\n<p>Adem\u00e1s, seg\u00fan el Decreto Supremo N\u00b0 014-2019-MIMP, que aprueba el Reglamento de la Ley N\u00b0 27942, Ley de Prevenci\u00f3n y Sanci\u00f3n del Hostigamiento Sexual, establece como deber de todas las empresas con m\u00e1s de 20 trabajadores la conformaci\u00f3n de un comit\u00e9 de intervenci\u00f3n frente al hostigamiento sexual.<\/p>\n<p>Este comit\u00e9 tiene como objetivo investigar las quejas o denuncias recibidas, emitir recomendaciones de sanci\u00f3n y tomar cualquier otra medida adicional para prevenir casos futuros de este tipo.<\/p>\n<p>Una de las acciones clave de este comit\u00e9 es la formaci\u00f3n y capacitaci\u00f3n de todos los miembros de la organizaci\u00f3n en materia de hostigamiento sexual desde el inicio de la relaci\u00f3n laboral. Estas sesiones de sensibilizaci\u00f3n no solo informan sobre el procedimiento a seguir en caso de identificar casos de hostigamiento, sino que tambi\u00e9n promueven una cultura de respeto y equidad en el ambiente laboral.<\/p>\n<p>En este contexto, las v\u00edctimas de hostigamiento sexual en el \u00e1mbito laboral tambi\u00e9n tienen la posibilidad de recurrir a la SUNAFIL para presentar su denuncia. Las autoridades laborales deben supervisar activamente el cumplimiento de estas medidas. Las empresas que no tomen las precauciones adecuadas y no sigan los procedimientos requeridos est\u00e1n sujetas a sanciones graves.<\/p>\n<p>Para terminar, es importante comprender que la prevenci\u00f3n del hostigamiento sexual en el lugar de trabajo es un esfuerzo colectivo que requiere el compromiso tanto de las empresas como de los trabajadores. Es un proceso continuo de aprendizaje y mejora que fortalece no solo la cultura empresarial, sino tambi\u00e9n la dignidad y el bienestar de cada individuo en el entorno laboral. Por lo que, debemos ser conscientes de nuestros derechos y responsabilidades en el entorno laboral.
