Una de las empresas fue multada por infringir las normas de protecci\u00f3n al consumidor relacionadas con informaci\u00f3n, publicidad y derechos de retracto y reversi\u00f3n del pago.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Las otras seis empresas fueron multadas por el incumplimiento a requerimientos de informaci\u00f3n hechos por la Superindustria para verificar , entre otras,\u00a0 las modificaciones o restricciones en la prestaci\u00f3n de los servicios funerarios con ocasi\u00f3n del virus COVID -19, obstaculizando las acciones de inspecci\u00f3n y vigilancia de la autoridad.\u00a0<\/span><\/p>\n<p style=\"text-align: left\"><b>Caso de infracci\u00f3n a las normas de protecci\u00f3n al consumidor:<\/b><\/p>\n<p><span style=\"font-weight: 400\">La Superindustria, a trav\u00e9s de la Resoluci\u00f3n 76497 de 2020, sancion\u00f3 a la <\/span><b>COOPERATIVA INVERSIONES Y PLANES DE LA PAZ LIMITADA \u2013COOINPAZ LTDA-<\/b><span style=\"font-weight: 400\"> con multa de <\/span><b>SETENTA MILLONES DOSCIENTOS VEINTICUATRO MIL DOSCIENTOS CUARENTA PESOS M\/CTE ($70.224.240)<\/b><span style=\"font-weight: 400\">, por incumplir las normas que regulan la informaci\u00f3n m\u00ednima, las condiciones espec\u00edficas y objetivas anunciadas en la publicidad, promociones y ofertas y ventas que utilizan m\u00e9todos no tradicionales.<\/span><\/p>\n<p><span style=\"font-weight: 400\">La anterior decisi\u00f3n se adopt\u00f3 luego de adelantar el correspondiente procedimiento administrativo sancionatorio, en el que se demostr\u00f3 que COOINPAZ LTDA. ofreci\u00f3 planes de protecci\u00f3n exequial induciendo en error a los consumidores, al incluir en su publicidad afirmaciones objetivas sobre la eliminaci\u00f3n del requisito de edad para la afiliaci\u00f3n y acceso de los servicios funerarios. As\u00ed, la Superintendencia de Industria y Comercio, determin\u00f3 en este caso que la referida sociedad:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">No garantiz\u00f3 el derecho que les asist\u00eda a los consumidores a ser protegidos contra la publicidad enga\u00f1osa, toda vez, que la informaci\u00f3n suministrada en la pieza publicitaria denominada <\/span><i><span style=\"font-weight: 400\">\u201cBeneficios adicionales a que tiene derecho\u201d<\/span><\/i><span style=\"font-weight: 400\">, respecto de las condiciones o requisitos de edad, omiti\u00f3 informaci\u00f3n que era necesaria para la adecuada comprensi\u00f3n de dicha publicidad, haciendo creer a los consumidores que se pod\u00edan afiliar sin l\u00edmite de edad, cuando el clausulado del contrato se\u00f1alaba exactamente lo contrario.<\/span><\/li>\n<li><span style=\"font-weight: 400\">No les indic\u00f3 a los consumidores los t\u00e9rminos, condiciones y restricciones para participar en los sorteos anunciados en la pieza publicitaria denominada <\/span><i><span style=\"font-weight: 400\">\u201cYa tiene su bono Excelencia al cumplimiento?\u00bb<\/span><\/i><span style=\"font-weight: 400\">, por lo que dicha publicidad se torn\u00f3 enga\u00f1osa al transmitir un mensaje insuficiente, en el que no se indicaron las condiciones de tiempo, modo y lugar para acceder a la actividad promocional.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">No les indic\u00f3 a los consumidores el t\u00e9rmino de vigencia de la promoci\u00f3n <\/span><i><span style=\"font-weight: 400\">\u201cBono de Descuento Presentando este cup\u00f3n cancele \u00fanicamente $30.000\u201d<\/span><\/i><span style=\"font-weight: 400\">, por lo que dicha pieza publicitaria se torn\u00f3 enga\u00f1osa al transmitir un mensaje insuficiente respecto de las condiciones de tiempo que rodeaban dicha promoci\u00f3n.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">No inform\u00f3 de manera suficiente a los consumidores, las condiciones y procedimiento para ejercer<\/span><span style=\"font-weight: 400\"> los derechos de retracto y la reversi\u00f3n del pago, en las ventas por m\u00e9todos no tradicionales que realizaba a trav\u00e9s de la de la modalidad de abordaje intempestivo.<\/span><\/li>\n<\/ul>\n<p><b>Casos de incumplimiento en la entrega de informaci\u00f3n:<\/b><\/p>\n<p><span style=\"font-weight: 400\">La Superindustria sancion\u00f3 a seis (6) prestadores de servicios exequiales, por no atender los requerimientos de informaci\u00f3n que fueron solicitados por esta Entidad, con el fin de verificar, entre otras,\u00a0 las modificaciones y restricciones en la prestaci\u00f3n de los servicios funerarios con ocasi\u00f3n del virus COVID &#8211; 19, las medidas de bioseguridad implementadas para el manejo seguro, transporte y disposici\u00f3n de cad\u00e1veres, y la informaci\u00f3n suministrada a los consumidores al respecto.
