Para este organismo, el \u00f3rgano de control no puede revocar la elecci\u00f3n por voto popular.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\">Felicitaciones a Carlos Rodr\u00edguez y Rafael Barrios mis abogados ante la CIDH. Han obtenido un triunfo contra la arbitrariedad.<\/p>\n<p>Aqui secciones de la sentencia. La procuradur\u00eda no puede suspender derechos pol\u00edticos ni destituir funcionarios de elecci\u00f3n popular <a href=\"https:\/\/t.co\/PLxlDQkdTt\">pic.twitter.com\/PLxlDQkdTt<\/a><\/p>\n<p>&mdash; Gustavo Petro (@petrogustavo) <a href=\"https:\/\/twitter.com\/petrogustavo\/status\/1295845452571652097?ref_src=twsrc%5Etfw\">August 18, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p style=\"text-align: justify\">Esta pelea inici\u00f3 en la Corte Internacional hace ocho a\u00f1os cuando Alejandro Ord\u00f3\u00f1ez, el entonces procurador, destituy\u00f3 a Petro como alcalde de Bogot\u00e1 luego de haberlo investigado disciplinariamente tras irregularidades en el cambio del sistema de recolecci\u00f3n de basuras de la ciudad.<\/p>\n<p style=\"text-align: justify\">En esa \u00e9poca, la contralor\u00eda distrital y la Superintendencia de Industria y Comercio hab\u00eda multado a Petro con 90.000 millones de pesos. Los argumentos eran que ese sistema, decretado por la alcald\u00eda, era ilegal, inconstitucional e iba en contra de la libre competencia. Otra multa fue por 40.000 millones por los carros de basura que jam\u00e1s se usaron y terminaron en parqueaderos o bodegas en Bogot\u00e1.<\/p>\n<p style=\"text-align: justify\">Con esta decisi\u00f3n del la Corte Interamericana de Derechos Humanos, el Estado colombiano debe ajustar su ordenamiento jur\u00eddico: \u00abla Corte concluye que las sanciones impuestas por la Contralor\u00eda pueden tener el efecto pr\u00e1ctico de restringir derechos pol\u00edticos\u00bb. Pero el llamado especial y argumento fuerte es que \u00abuna sanci\u00f3n de inhabilitaci\u00f3n o destituci\u00f3n de un funcionario p\u00fablico democr\u00e1ticamente electo por v\u00eda de autoridad administrativa y no por condena, por juez competente, en proceso penal, es contraria al art\u00edculo 23 de la Convenci\u00f3n Americana\u00bb.<\/p>\n<p style=\"text-align: justify\">Y puntualiza:\u00bbPor lo tanto, el Estado debe propiciar las condiciones y mecanismos para que dichos derechos puedan ser ejercidos de forma efectiva, respetando el principio de igualdad y no discriminaci\u00f3n\u00bb.
